Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Imgwerx L.L.C. ("Zetfeed," "we," "us") governing your use of the Zetfeed apps and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree to them, you may not use the Service.

1. Eligibility

You must be at least 13 years old (or older if required by the laws of your country or region) to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly at hello@zetfeed.com if you believe your account has been compromised. You may delete your account at any time from your settings, and you may request a copy of your personal data as described in our Privacy Policy.

3. The Service

Zetfeed is a news reader: you choose sources and topics, and we fetch, organize, and display content from those sources for your personal use. To do this, our servers retrieve and temporarily store content from the feeds and pages you subscribe to. We may add, change, or remove features over time.

4. Subscriptions and billing

Zetfeed offers free and paid ("Member") features. Paid subscriptions are sold and billed through the app store on your device and are subject to that store's terms. Payment is charged to your app-store account, and subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You manage or cancel your subscription in your app-store account settings; we cannot cancel or refund app-store purchases on your behalf. Any free trial we offer may convert to a paid subscription, depending on the type of trial provided; where a trial is set up to convert automatically, it will do so unless you cancel before it ends.

5. Acceptable use

You agree not to:

  • Use the Service to store, distribute, or link to content that is unlawful or that infringes the intellectual property or other rights of others.
  • Point the Service at feeds or URLs in order to abuse it as a proxy, to attack or overload other systems, or to circumvent access controls.
  • Attempt to breach or probe the security of the Service, disrupt it, or access data that is not yours.
  • Scrape, resell, or redistribute the Service or its content except as expressly permitted.
  • Harass, abuse, or harm others, or misrepresent your identity.

We may investigate suspected violations and cooperate with law enforcement where required by law.

6. Third-party content

The articles, feeds, and media you read through Zetfeed are created and owned by third parties, not by us. We do not endorse and are not responsible for third-party content, and your use of it may be subject to the terms and policies of its publisher. We cache content solely to display it to you as part of the reading experience.

7. Copyright and DMCA

Zetfeed is a personal reader for browsing publicly available feeds that you choose to follow. We display the content that publishers make available in those feeds, with a link back to the original source, and we do not present that content as our own or sell it.

We store the content a publisher includes in its feed so we can display it to you, as the publisher chose to distribute it, and we do not retain additional article content beyond what appears in the feed. We do not host or store the images shown in articles; they load directly from the source's own servers. When you open an article's full text, it is retrieved fully on demand and on-device via our apps, and does not reach our servers. When accessed via the website, it is retrieved on your behalf, and a transient copy is kept briefly to display it to you alone and is not stored in our database. The only images we store are freely-licensed images (for example, public-domain or Creative Commons images from Wikimedia Commons), which we display with the attribution their license requires.

If you are a rights holder who would prefer that your content not appear in the Service, you do not need to file a formal notice to have it removed. Because we do not host the images and other media shown in articles — they load directly from a publisher's servers — removing or restricting that media at the source stops it from appearing here as well. For anything else, a message to our designated agent (contact below) identifying the feed or content is enough, and we will act on it promptly.

We respect intellectual property rights and expect you to do the same. If you believe content available through the Service infringes your copyright, send a notice to our designated agent with: your contact details; identification of the copyrighted work; the location of the material; a statement of good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and your signature.

Repeat infringers. We will, in appropriate circumstances, terminate the accounts of users who repeatedly infringe or are repeatedly the subject of valid infringement notices.

8. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we reasonably believe your use creates legal risk or harm to others or to the Service. If we terminate your account for cause, you may not create a new account, and we may take reasonable steps to prevent re-registration, including retaining a one-way hash of your email address for that purpose, as described in our Privacy Policy. You may stop using the Service and delete your account at any time.

9. Anonymous, aggregate data

We may create and share anonymous, aggregate statistical information about content trends and reader engagement — with partners and the public. This information never identifies you and cannot reasonably be linked back to you. We never sell personal information. You may opt out of having your reading activity included in these anonymous statistics by emailing hello@zetfeed.com with the subject "Opt-out Request". In your message, include your account's email address, which is displayed under your name at the top of the "You" page. We may be unable to process your request if we do not have this exact email address. Note that the address may be different from one that you typically use, especially if you signed up using Apple or Google.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content retrieved from third-party sources will be accurate or available.

11. Limitation of liability

To the fullest extent permitted by law, Imgwerx L.L.C. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or US $50. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud, gross negligence, or willful misconduct, or for death or personal injury caused by our negligence.

12. Indemnification

You agree to indemnify and hold Imgwerx L.L.C. harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service or violation of these Terms or of any law or third-party right.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Arizona, and you consent to the personal jurisdiction of those courts.
